Why families build an ADU for grown kids

California rents and home prices have made it hard for young adults to launch on their own. An ADU solves the math without anyone giving up independence:

What California law allows in 2026

The rules are firmly on your side, and state law preempts most local restrictions:

  • A detached ADU up to 1,200 sq ft is allowed, and cities must permit at least an 800 sq ft / 16 ft tall ADU.
  • Side and rear setbacks max out at 4 feet. Front setbacks match your primary home.
  • Approval is ministerial, with a 60-day decision once your application is complete. No public hearing, no discretionary review.
  • Owner-occupancy is permanently removed for a standard ADU. You do not have to live on the property, which matters if you ever move and your kids stay.
  • A single-family lot can have the primary home plus one ADU plus one JADU.

One distinction worth knowing: a JADU (junior ADU) is up to 500 sq ft, must sit within your existing home’s walls, and does still require owner-occupancy. Few families pay cash, and they do not need to. The most common ways to fund an ADU for adult children:

  • HELOC or cash-out refinance against your home’s equity, which is usually the cheapest money available.
  • Renovation or construction loans built specifically for adding square footage.
  • A family arrangement where your adult child contributes monthly toward the loan payment, effectively paying themselves into equity in the home you own.

Questions families ask

Can my adult child have their own address and entrance?

Yes. A detached ADU is a fully separate dwelling with its own entrance, kitchen, bathroom, and in most cities its own address. That separateness is exactly what makes an ADU work for grown kids instead of a finished basement or garage room.

Do I have to charge my kids rent?

No. There is no legal requirement to charge rent to a family member living in your ADU. Many families charge a modest amount to cover the loan, and many charge nothing. It is entirely your call.

Will building an ADU raise my property taxes a lot?
